Chapter 13 Bankruptcy: Your Rights and Options
Chapter 13 bankruptcy allows you to put your creditors and banks on hold while you try to restructure your finances. Ideally, a Chapter 13 bankruptcy will allow you to restructure your debts so that you can move forward and pay off your debts in the future. When a bankruptcy allows you to remove some of your debt, you will have enough money to pay off a mortgage and keep your home.

What if I Cannot Afford My Mortgage?
If you cannot afford your mortgage, you do have options. You could either pursue a deed in lieu of foreclosure or consider other options through bankruptcy, depending on whether you want to keep your home. If you have a second mortgage on your home, you can also consider loan stripping so that you can eliminate debt on a 2nd mortgage and simply pay off the first. If your house has declined in value so that the 2nd mortgage is unsecured, you can get it stripped or eliminated through bankruptcy.
